User Agreement

Effective Date: November 28, 2025

This User Agreement (the «Agreement») governs the relationship between Pixel360 Design Limited («Pixel360», «we», «us») and you, the user of our website and services.

1. User Status (Consumers and Business Customers)

Users of Pixel360 may be either consumers (individuals acting outside their trade, business or profession) or business customers (companies or sole traders purchasing services for commercial use).

If you are a consumer, the Consumer Rights Act 2015 and the Consumer Contracts Regulations 2013 apply to your contract with us.

If you are a business customer, the Unfair Contract Terms Act 1977 applies.

2. Quality of Digital Content

We will provide all digital content (including credits, images, 3D models and related assets) with reasonable skill and care and in accordance with its description, as required under the Consumer Rights Act 2015.

If the digital content is defective, a consumer is entitled to a repair, replacement or refund at no additional cost. These statutory rights cannot be excluded.

3. Order Acceptance and Payment

By placing an order, you confirm that you understand these Terms and agree to pay for the order.

The checkout button will clearly indicate that placing the order creates an obligation to pay.

Your order is accepted when we send you an email confirming the order, at which point a contract is formed.

4. Data Protection (UK GDPR)

We process personal data in accordance with UK GDPR and our Privacy Policy. This includes processing necessary to create and manage your account, fulfil your order, provide customer support, process payments and send service-related notifications.

Users have the right to access, correct, delete or restrict their data, to object to processing, and to withdraw consent at any time. Full details are provided in our Privacy Policy.

5. Pre-Contract Information

Before completing a purchase, Pixel360 provides clear information about the service or digital content, the total price including taxes, any additional fees, and the applicable delivery and refund terms.

6. Consumer Right to Cancel (14 Days)

6.1. Standard Cancellation Right
If you are a consumer, you have a statutory right to cancel your order within 14 days without giving any reason.

6.2. Digital Content Exception
Digital content (including credits, downloads and access to content libraries) may be supplied immediately upon request.

You acknowledge that by requesting immediate access to digital content, you lose your statutory right to cancel under the Consumer Contracts Regulations 2013. This consent is obtained during checkout.

6.3. Refunds
If you exercise a valid cancellation right, Pixel360 will refund all payments received within 14 days of receiving your cancellation notice.

7. Digital Content Delivery Rules

We will not begin supplying digital content during the 14-day cancellation period unless you have expressly requested immediate delivery and acknowledged that you lose your right to cancel once delivery begins.

8. Limitation of Liability

8.1. Consumers
Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence. Any limitations of liability applied to consumers must be fair and proportionate in accordance with the Consumer Rights Act 2015. We do not exclude liability for rights which cannot be limited under consumer law.

8.2. Business Customers
For business customers, our total liability in relation to any order is limited to the amount paid for that order, to the extent permitted by the Unfair Contract Terms Act 1977. Nothing in these Terms excludes liability for death or personal injury caused by negligence.

9. Dispute Resolution and ADR

Consumers are not required to use arbitration and retain the right to bring claims before a court in their country of residence.

If a dispute cannot be resolved directly with us, you may use an independent certified Alternative Dispute Resolution (ADR) provider or pursue the matter in court. Pixel360 currently does not participate in ADR schemes.

10. Governing Law

These Terms are governed by the laws of England and Wales. Consumers may bring legal proceedings in the courts of their country of residence.

11. Intellectual Property and Licensing of Digital Content

When you purchase or download digital content from Pixel360, you receive a limited, non-exclusive licence to use that content in accordance with the Pixel360 Content Licence Agreement.

You do not obtain ownership of the content. Where attribution is required under the licence, you agree to provide appropriate credit to Pixel360 or the relevant rights holder.

12. Cookies and Electronic Communications

We use cookies in accordance with our Cookie Policy and the Privacy and Electronic Communications Regulations (PECR).

Non-essential cookies will only be used with your consent.

You may opt out of marketing communications at any time.

13. Changes to These Terms

We may update these Terms from time to time. Where changes are material, we will notify users via email, account notice or website banner. Continued use of the website after such updates constitutes acceptance of the revised Terms.
